Acceptance of Terms

By downloading, installing, or using Esperanza Health ("the App"), you agree to these Terms of Service. If you do not agree, please do not use the App.

Description of Service

Esperanza Health is a personal caregiving organization tool designed to help you track medications, appointments, vitals, documents, voice recordings, and other healthcare-related information for yourself or your loved ones. The App is provided free of charge with no in-app purchases.

Not Medical Advice

Esperanza Health is not a medical device and does not provide medical advice, diagnoses, or treatment recommendations. The App is an organizational tool only. Information stored in the App, including medication schedules, vital readings, and AI-generated transcription summaries, is for personal reference and should not be used as a substitute for professional medical advice. Always consult a qualified healthcare provider for medical decisions. In case of a medical emergency, call 911 or your local emergency number immediately.

Accuracy of Information

You are responsible for the accuracy of all data you enter into the App. We do not verify or validate any health information, medication details, or other data stored in the App. AI transcription is provided as a convenience and may contain errors. Always review transcriptions and extracted action items for accuracy. Do not rely solely on AI-generated content for healthcare decisions.

Your Data

All data you create in the App is yours. We do not collect, access, or store your data on our servers. You are responsible for maintaining backups of your data. Enabling iCloud sync is recommended but optional. We are not responsible for data loss resulting from device failure, software issues, accidental deletion, or any other cause.

Limitation of Liability

To the fullest extent permitted by applicable law, Esperanza Health ("we," "us," or "our") shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Missed medication reminders or appointment notifications
• Inaccurate AI transcriptions or extracted action items
• Data loss or corruption
• Any decisions made based on information stored in or generated by the App

The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

Acceptable Use

You agree to use the App only for its intended purpose as a personal caregiving organization tool. You agree not to attempt to reverse engineer, modify, or distribute the App or its source code.

Changes to These Terms

We may update these Terms of Service from time to time. Updated terms will be posted within the App with a revised "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated terms.
